These Terms and Conditions (“Terms”) govern your use of the Eagle Business Loans website at https://portal.eaglebusinessloans.com/, our online financing application, and our client portal (together, the “Services”). By creating an account, submitting an application, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Who we are
Eagle Business Loans is a commercial financing broker. We are not a lender and we do not make credit decisions. We help businesses find and apply for financing products offered by independent third-party lenders, funders, banks, and other financing providers (“Funding Partners”). Any approval, offer, rate, fee, term, or funding decision is made solely by the Funding Partner, under its own agreement with you.
2. Business purposes only
The Services are intended for businesses seeking commercial financing for business purposes. They are not intended for personal, family, or household financing. You represent that you are at least 18 years old and authorized to act on behalf of the business you identify.
3. No guarantee of financing
Financing options, matches, estimates, calculators, and other information shown to you are for general information only and are not offers, commitments, or approvals. We do not guarantee that you will qualify for or receive financing, or that any terms will be available.
4. Accurate information
You agree that all information and documents you provide are true, complete, and current, and that you will promptly update them if they change. Providing false or misleading information may result in denial of financing, closure of your account, and other consequences under applicable law.
5. Authorization to share information with Funding Partners
When you separately authorize it in your application or client portal, you permit us to share your application, business and owner information, and documents with one or more Funding Partners so they can evaluate your request. Funding Partners may obtain credit reports, verify information, and contact you directly, subject to their own terms and privacy policies. You may withdraw this authorization for future submissions at any time by contacting us.
6. Our compensation
We may receive compensation from Funding Partners when financing is provided, which may vary by Funding Partner and product. Any fee charged directly to you will be disclosed to you in writing before you are obligated to pay it.
7. Communications consent
If you check the communications consent box, you agree that Eagle Business Loans and our Funding Partners may contact you about your financing request by email, telephone, and text message at the numbers and addresses you provide, which may include automated or pre-recorded messages. Consent is not a condition of obtaining financing. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of text messages, or HELP for help. Account and security emails (such as email verification and document requests) are sent regardless of marketing preferences.
8. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately if you suspect unauthorized access. We may suspend or close accounts that violate these Terms or that we believe are being used fraudulently.
9. Electronic records and signatures
You agree to receive disclosures, notices, and records electronically, and that your electronic acceptance (such as checking a box or clicking a button) has the same effect as a handwritten signature.
10. Acceptable use
You agree not to misuse the Services, including by uploading malicious files, attempting to access another person’s information, interfering with security features, or using the Services for any unlawful purpose.
11. Intellectual property
The Services and their content, design, and trademarks are owned by Eagle Business Loans or its licensors and may not be copied or used without permission, except to use the Services as intended.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. We are not responsible for the products, decisions, acts, or omissions of any Funding Partner.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Eagle Business Loans WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICES OR ANY FINANCING OBTAINED THROUGH THEM.
14. Privacy
Our Privacy Policy explains how we collect, use, and share your information and is part of these Terms.
15. Changes and governing law
We may update these Terms from time to time. The “Last updated” date shows when they last changed; continued use of the Services after a change means you accept the updated Terms. These Terms are governed by the laws of the state in which Eagle Business Loans maintains its principal place of business, without regard to conflict-of-laws rules.
